By accessing or using Mothermind ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Mothermind is a digital platform providing birth confidence and mental health support for expecting parents, their partners, and birth professionals. Our services include:

• Emotional check-in tools to help you identify and express your feelings
• Personalised responses and coping strategies based on your emotional state
• Educational content about birth preparation and mental wellbeing
• Progress tracking and insights about your emotional journey

3. Eligibility

To use Mothermind, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

4. Account Responsibilities

When you create an account with Mothermind, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activities.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or servers
• Upload viruses, malware, or other malicious code

• Share your account credentials with others

6. Not Medical Advice

Mothermind provides emotional support and educational content only. We do not:

• Diagnose or treat any medical or mental health conditions
• Provide emergency medical services
• Replace advice from qualified healthcare professionals
• Guarantee any specific health outcomes

Always consult your midwife, doctor, or mental health professional for medical concerns. In a medical emergency, call 999 immediately.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Mothermind and are protected by UK and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Service without our prior written consent.

8. User Content

When you submit content through the Service (such as check-in responses or feedback), you:

• Retain ownership of your content
• Grant us a licence to use, process, and store your content to provide the Service
• Warrant that your content does not violate any third-party rights
• Understand that anonymised, aggregated data may be used for research and service improvement

9. Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Donations

If you make a donation to Mothermind:

• All donations are voluntary and non-refundable except as required by law
• Donations are processed securely through Stripe
• We do not store your payment card details
• Donations support the development and operation of Mothermind

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee the Service will be uninterrupted, secure, or error-free
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid to us in the past 12 months

Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless Mothermind, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your access to the Service immediately, without prior notice, if:

• You breach any provision of these Terms
• We are required to do so by law
• We decide to discontinue the Service

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
